According to legal scholar Jane Kirtley, of the University of Minnesota, the Macrons' case faces high legal hurdles, because to prevail in U.S. defamation cases, public figures must show defendants engaged in "actual malice," a tough legal standard requiring proof the defendants knew what they published was false or had reckless disregard for its truth. "I think he's [President Macron] probably not giving enough deference to the fact that courts in the United States grant broad discretion to individuals to comment on public officials," Kirtley said. The Macrons' complaint, filed in Delaware Superior Court, said that Owens has waged a lie-filled "campaign of global humiliation" to promote her podcast and expand her "frenzied" fan base. Examples cited included the claim that Brigitte Macron, 72, was born under the name Jean-Michel Trogneux, the actual name of her older brother.
