This decision comes after a U.S. judge ordered his immediate release Thursday and allows Garcia to return home – at least temporarily – to Maryland. Though the Trump administration has said they would appeal the court decision, another order was issued Friday, blocking ICE officials from detaining Garcia again, according to his lawyer. Garcia, 30, was deported to El Salvador in March despite a 2019 U.S. immigration court ruling that he not be sent back to his native country due to a risk of persecution by gangs. He was then flown back to the U.S. in June to face criminal charges of transporting migrants living illegally in the United States. After pleading not guilty in this criminal case, Garcia was being held in ICE custody since August.
